Elected leaders in the three Lane County cities already have approved bans on marijuana businesses, but voter approval is needed to implement the prohibitions. If approved, the measures on the Nov. 8 ballot would ban recreational and medical marijuana retailers, dispensaries, processors, producers and wholesalers within the cities. There are no such businesses in the three cities now.

Results from the 2014 election show a slight majority of voters in Creswell and Coburg supported statewide recreational marijuana legalization, while in Junction City a small majority of voters opposed it. A little more than 51 percent in Creswell and Coburg voted for recreational marijuana legalization in 2014, with a little less than 49 percent voting against it. In Junction City, 51 percent voted against legalization and 49 percent voted for it. Following voter approval of Measure 91 in 2014, Oregon lawmakers added stipulations allowing for cities and counties to institute bans on pot businesses. In Lane County and other counties where voters overall supported pot legalization, voters in individual cities are allowed to institute marijuana business bans. At least one marijuana retailer is waiting on the vote to decide whether to continue her efforts to establish a shop in Coburg. In Creswell, city councilors put a ban on the ballot so a local vote, rather than the statewide pot-legalization vote, would determine marijuana’s place in the community, according to City Administrator Michelle Amberg.

“They want Creswell to decide for Creswell,” she said. Cities and counties with bans on marijuana businesses will not receive local or state tax revenue brought in from recreational pot sales. Along with a ban, Creswell voters will decide whether to institute a 3 percent sales tax on recreational marijuana sales in the city. The tax would go into effect only if approved and if the ban fails. Around Oregon, 45 cities and five counties have marijuana business bans on the ballot, according to the Oregon Liquor Control Commission. Outside Lane County, cities include Brownsville, Harrisburg, Lebanon and Sutherlin. Counties also may pursue a ban for unincorporated areas, and Douglas and Linn counties have measures on the Nov. 8 ballot to do that. The OLCC and the Oregon Health Authority have had a moratorium on issuing licenses or permits for marijuana businesses in cities and counties where voters will decide on pot business bans. The OLCC is taking over supervision of the state’s recreational marijuana program.

The Health Authority regulates medical marijuana. Overall, Lane County voters were more than 60 percent in favor of recreational pot legalization, and about 40 percent voted against it. In counties where 55 percent or more of voters in 2014 voted against marijuana legalization, city and county leaders may ban marijuana businesses without a public vote. The OLCC reports that 39 cities and 13 counties have done so. Cities include Baker City, Burns and Klamath Falls. Counties include Baker, Malheur and Klamath. In Coburg, the prospect of marijuana retailing already has been contentious. The City Council voted in August 2015 to deny a California woman’s application to open a medical marijuana dispensary in the Matthews House, a historic downtown property. Charree Richey — a former Redding, Calif., resident who applied to have the dispensary — said she is waiting to see what voters decide. If Coburg voters approve the ban, she’ll give up on her marijuana business dreams in the city.
