We entered into a contract with Mr Richardson on 01/06/2016. We do require a 33% deposit from any client for any type of work we do. After signing the contract and three business days have passed the client is obligated to the contract and its terms and conditions. Under our General terms it states that we are not responsible for any unforseen problems. Also we are not responsible for buildings not meeting local building codes which resulted with Mr Richardsons job . When we arrived our first scheduled task was to dig around the existing patio so we could drill the rebar into the existing patio. It was than that we discovered that Mr Richardsons patio would not meet code. this was not something that could be done prior to starting the work. When we give an estimate we do a visual inspection of the work site and we rely on the information given to us by the client or building official. Mr Richardson had stated that his builder had told him when he bought the home that the patio was designed with a proper footer so it could be converted to a screen room at a later date.

We advised Mr Richardson that day of our discovery and said we would have to consult with the local building officials as well as our architect. We arranged for a meeting there with our architect and have a signed letter from him which we forwarded to Mr Richardson that what they had would not be suffficient to build a screen room and would not meet local building codes. Mr Richardson continued to suggest that his builder assured him that there patio would meet code and so at that point there was nothing that we could do but bring the patio up to code so we could build the screen room as agreed. Mr Richardson stated that they would not be able to pay any additional costs and requested a release from there contract because they felt our company was at total blame and this was something we should have known prior to signing the contract which is just not possible. My position in the company is Vice President while my wife is the President of the company. I do not recall ever specifically stating to Mr Richardson that I was the licensed contractor.

I do oversee the daily operations of the business and I do have total authority to sign the contracts , pull permits, and run any job that is performed for 1st Choice General Contracting. We made an offer to Mr Richardson that we did not have to make after the discovery about the extra work that was needed. As a fair gesture we offered our services in the future to Mr Richardson and his wife and would give them a credit for the deposit, the NON REFUNDABLE deposit that was made for any future repairs to the home or any future services that may be needed to the home up to the amount of the deposit that was made. Mr Richardson declined our offer. In reverence to the court date. Mr Richardson had requested a post postponement for the birth of his baby so he could be there for that event and this was a justified postponement in our opinion. We wish Mr Richardson and his family a very happy, healthy, and prosperous future together. We were informed of this postponement by mail and a phone call stating that the court would let us know when the new court date would be.
